Part 4: Despite False Rhetoric, Reining In NLRB Good for Job Creators and American Workers

House Republicans are advancing legislation that will prohibit the National Labor Relations Board (NLRB) from dictating where a private employer can and cannot create jobs. Critics of the Protecting Jobs from Government Interference Act (H.R. 2587) have touted bogus rhetoric in an attempt to discredit this sensible reform. The Education and the Workforce Committee is committed to supporting America's workers and separating the myths from the facts.

MYTH: The Protecting Jobs From Government Interference Act is an unprecedented attempt by Congress to interfere in a pending legal matter.

FACT: This is not the first time Congress has intervened in ongoing legal matters. In fact, Democrat lawmakers have offered their support to legislation that would place Congress in the midst of pending legal cases. Examples of this congressional action include:

  • Lilly Ledbetter Fair Pay Act of 2009 (Passed House of Representative, 250-177, 1/27/2009)
  • Foreign Intelligence Surveillance Act Amendments Act of 2008 (Passed House of Representatives with bipartisan support, 293-129, 6/20/2008)
  • Fraud Enforcement and Recovery Act of 2009 (Passed House of Representatives with bipartisan support, 338-52, 5/18/2009)

FACT: Not only does the NLRB’s decision to force Boeing to relocate work to Washington state threaten thousands of jobs in South Carolina, it is already having a chilling effect on business both at home and abroad.

FACT: At an Education and the Workforce Committee hearing, former NLRB Chairman Peter Schaumber described his encounter with some of Canada’s largest business leaders. As Schaumber noted, “A few with whom I had an opportunity to speak afterwards expressed real concern about doing business in the United States as a result of the agency's complaint against the Boeing Company.”

FACT: The Protecting Jobs From Government Interference Act ensures no worker has to live with the fear of losing his or her job due an activist NLRB trying to exercise an extreme remedy in labor law.

Unfortunately, this is not the only myth propagated by those who support the job-destroying, activist agenda of an unaccountable National Labor Relations Board (see Part 1, Part 2, and Part 3 of this series). Republicans are determined to set the record straight.
