***MEDIA ADVISORY*** Committee to Mark Up the Workforce Democracy and Fairness Act

H.R. 3094 reaffirms long-standing protections for workers and employers

On Wednesday, October 26 at 10:00 a.m., the U.S. House Committee on Education and the Workforce, chaired by Rep. John Kline (R-MN), will hold a markup of the Workforce Democracy and Fairness Act (H.R. 3094). The markup will take place in room 2175 of the Rayburn House Office Building.

In June, the National Labor Relations Board (NLRB) issued a proposal that will significantly alter the rules governing union elections. Most notably, employers will have just seven days to find legal representation and prepare a case to present before an NLRB hearing officer. Additionally, workers may have as few as 10 days to decide whether or not to join a union.

The board also recently issued a decision in the Specialty Healthcare case that abandoned the traditional standard for determining which group or “unit” of employees will participate in the union. The decision empowers unions to manipulate the workplace to their advantage while undermining employees’ freedom in the workplace and raising an employer’s labor cost.

In response to these activist decisions, Chairman Kline and committee Republicans introduced the Workforce Democracy and Fairness Act (H.R. 3094). The legislation restores successful labor practices and reaffirms protections workers and employers have received for decades. H.R. 3094 ensures employers have access to a fair election hearing and employees are able to make a fully informed decision about union representation.
