ICYMI: House Reaffirms Long-Standing Workforce Protections

H.R. 3094 Rolls Back NLRB's Activist Agenda

On Wednesday, the U.S. House of Representatives passed with bipartisan support legislation to protect employers' free speech and workers' free choice in a union election. The Workforce Democracy and Fairness Act (H.R. 3094) rolls back the Obama National Labor Relations Board's devastating ambush election scheme and preserves employee freedom in the workplace. The legislation is a key component of the House Republican jobs agenda that will remove regulatory roadblocks to job creation.

The House passed legislation Wednesday to block a proposed rule by the National Labor Relations Board (NLRB) that would speed up union elections.

The bill, sponsored by Rep. John Kline (R-Minn.), chairman of the House Education and the Workforce Committee, passed the chamber 235-188. Only six Democrats voted for it, while eight Republicans voted against it. ...

"Let's get something straight," Kline said. "The board's scheme isn't about modernizing the election process. This is a draconian effort to stifle employer speech and ambush workers with a union election.

"Less debate, less information and less opposition," Kline added. "That's big labor's approach to worker's free choice, and it's begin rapidly implemented by the activist NLRB."

The House on Wednesday approved a bill designed to rein in the National Labor Relations Board in what GOP critics of the board said was an effort to stop the "rogue" agency from rewriting federal labor law to increase the ability of unions to organize a work site.

"Imagine voting on the president of the United States in 10 days," said Rep. David P. Roe, Tennessee Republican, during Wednesday’s floor debate.

"The board seems utterly determined to finalize this flawed proposal, regardless of the damage to the integrity of the board and our workplaces," he said. "Rest assured, we in Congress will continue to use every tool at our disposal to safeguard the rights of workers and employers."  Read more...

Republicans lawmakers in the House also approved a bill Wednesday aimed at short-circuiting the rules, which could make it more difficult for businesses to resist union organizers.

Republicans and business groups claim the labor board wants to give unions "quickie" elections without giving employers enough time to respond.

"The board's scheme isn't about modernizing the election process," said Minnesota Rep. John Kline, GOP chairman of the House Committee on Education and the Workforce. "This is a draconian effort to stifle employer speech and ambush workers with a union election."  Read more...

[T]he House passed by a 235-188 vote a bill that would roll back the NLRB rule. The legislation, sponsored by Rep. John Kline (R-Minn.), was drafted in response to the NLRB’s more sweeping earlier proposal and was the second whack at the labor board this fall by the GOP-led House, which in September approved a bill that would ban the NLRB from forcing companies to close or relocate jobs.  Read more...
