Kline, Walberg Seek Information on DOL's Overtime Proposal Outreach

 
Dear Secretary Perez:

On August 21, 2015, we were joined by 20 of our colleagues in requesting an additional 60 days of public comment on the U.S. Department of Labor’s (the Department) proposal to update the overtime regulations under the Fair Labor Standards Act. In a letter dated August 31, 2015, Wage and Hour Administrator David Weil denied this request, stating the initial 60-day comment period “provide[d] sufficient time for interested parties to submit comment.” Administrator Weil’s response also noted the Department’s outreach efforts between the issuance of the President’s March 13, 2014, memorandum directing you to update these regulations and the release of the Department’s regulatory proposal. As this outreach formed the basis for the Department’s refusal to provide the public more time to review and submit written comments, the Committee is requesting the following information no later than February 29, 2016:
 

1. A list of all in-person meetings, telephone calls, or any other communications with stakeholders or other parties (“outreach activities”) by the Department, including the dates and participants, concerning the President’s March 13, 2014, memorandum and the subsequent Notice of Proposed Rulemaking;
 

2. All documents, meeting notes, and any other materials prepared by the Department in connection with these outreach activities; and,
 

3. All documents and materials collected from outside stakeholders as a result of the Department’s outreach activities.
