Foxx: Biden is Intent on Ruling by Executive Decree

WASHINGTON – Today, Education and the Workforce Committee Chairwoman Virginia Foxx (R-NC) released the following statement on the Department of Labor’s (DOL) final overtime rule, which would negatively impact workers, small businesses, nonprofits, colleges, and universities:

“Any way you cut it, Biden’s overtime rule is a bad deal for American employers and workers. This administration thinks it’s a good idea to dust off an Obama-era proposal that was scuttled in court and pitch it as a win for the workforce. The reality is employers—including nonprofits and colleges—are staring down the barrel of billions in annual costs to comply with the rule. At the same time, many salaried workers will be forced into hourly positions—undermining their financial security and putting benefits and workplace flexibility at risk.

“Just four years ago, the Trump DOL raised the overtime limit in a widely agreed-upon compromise. Departing from that policy now will just create chaos and confusion for affected industries and lead to layoffs for hardworking Americans. No business owner running on tight margins in Biden’s economy will tell you that excessive and heavy-handed regulations from the federal government are the answer.  

“If the administration’s goal with this rule is to improve the standard of living for workers, then it’s failing miserably. Per usual, Biden is intent on ruling by executive decree.”
 
Background:

October 20, 2023: Chairwoman Foxx sent a letter to Acting Labor Secretary Su requesting that DOL extend its comment period on the proposed overtime rule.

November 7, 2023: Chairwoman Foxx and Workforce Protections Subcommittee Chairman Kevin Kiley submitted a comment letter to Acting Secretary Su urging the Department to withdraw its harmful proposed overtime rule. Fourteen Committee Members joined Foxx and Kiley in sending the letter, including: Reps. Thompson, Walberg, Stefanik, Allen, Comer, Smucker, Owens, Good, Steel, Miller, Letlow, Bean, Burlison, and Houchin. 

November 29, 2023: Workforce Protections Subcommittee Chairman Kiley held a hearing on DOL’s overtime rule titled "Bad for Business: DOL's Proposed Overtime Rule."
