NLRB’s Joint-Employer Rule Will Kill Jobs

Today, Education and the Workforce Committee Chairwoman Virginia Foxx (R-NC) issued the following statement after the National Labor Relations Board (NLRB) announced its joint-employer final rule:

“The old saying, ‘If it ain’t broke, don’t fix it’ applies perfectly in this case. The 2020 joint-employer rule provided a clear, consistent, and narrow standard for businesses on how two or more entities are determined to be joint employers under the National Labor Relations Act. Yet, Biden’s NLRB has decided to replace this rule with one that expands joint-employer liability and dissuades millions of businesses from working with one another.

“A rule should provide clarity to employers and workers, but what the NLRB has implemented muddies the water for businesses trying to abide by this administration’s mess of out-of-touch mandates. Business groups across the country submitted comments on how this rule would damage their respective industries. Franchisee owners, hospitals, restaurants, and any business relying on supply chain relationships will be hit the hardest. 

“It’s astounding how detached this rule is from reality. Allow me to offer some sage advice to this administration: Whatever you think is the right answer, do the opposite.”
