Foxx: Biden Isn’t Acting in the Best Interests of Job Creators and Working Americans

WASHINGTON – Today, Education and the Workforce Committee Chairwoman Virginia Foxx (R-NC) made the following statement in response to President Biden vetoing a Congressional Review Act (CRA) resolution to overturn the National Labor Relations Board’s (NLRB) joint employer rule, which imposes unnecessary costs and liabilities on job creators, dissuades millions from pursuing the American Dream, and weakens America’s economic might:
 
Biden’s joint employer rule is wildly unpopular. Businesses across the country have raised concerns about how this rule will lead to unnecessary regulatory hurdles, increased liabilities, and stifled flexibility. Instead of heeding these concerns, President Biden has vetoed Congress’ bipartisan attempt to block this harmful rule during National Small Business Week. With this veto, Biden is proving once again that he’s not acting in the best interests of job creators and working Americans.” 

Background:

The new rule saddles franchisors with the liability of individual franchise owners despite having no operational authority over the business’ employees. This threatens the viability of the franchise business model, a system that employs over eight million workers and has empowered Americans from all communities to become successful business owners. Additionally, the rule creates uncertainty among small and local businesses on their legal liabilities, leading to higher operational costs and less opportunity to create jobs. 
 
November 9, 2023: Chairwoman Foxx, Rep. John James (R-MI), Speaker Mike Johnson (R-LA), Senate Health, Education, Labor, and Pensions (HELP) Committee Ranking Member Bill Cassidy (R-LA), Sen. Joe Manchin (D-WV), and Senate Minority Leader Mitch McConnell (R-KY) introduced a Congressional Review Act (CRA) resolution to overturn NLRB’s new joint employer rule, which forces liability on companies for another business’ employees even if they do not directly oversee them.
 
January 12, 2024: Chairwoman Foxx spoke on the House Floor in support of H.J. Res. 98, a Congressional Review Actresolution to nullify the NLRB’s joint employer rule.
 
April 10, 2024: Chairwoman Foxx issued a statement on the overwhelming opposition to Biden’s joint employer rule, including Senate passage of a Congressional Review Act resolution to stop the job-killing mandate.
