Foxx Reacts to NLRB’s Surrender on Joint-Employer Court Decision

WASHINGTON – Today, Education and the Workforce Committee Chairwoman Virginia Foxx (R-NC) issued the following statement after the National Labor Relations Board (NLRB) abandoned its own appeal to the joint-employer standard ruling in the U.S. District Court for the Eastern District of Texas:

“Workers, small business owners, and entrepreneurs across the nation are certainly rejoicing today – the NLRB dropped to its knees and waved the white flag in utter defeat. The Biden administration’s joint-employer standard would have fast-tracked more government regulation while emboldening union bosses to press their thumbs down on hardworking Americans. Now, this failed policy can finally be buried in the ground where it belongs.”

BACKGROUND

The NLRB’s joint employer rule recklessly holds a company liable for employees it does not employ or directly supervise. This broadened language will confuse and harm franchisors, franchisees, and entrepreneurs across the country. A similar Obama-era standard cost the franchising sector an estimated $33.3 billion and 376,000 jobs.
